4. Age: No person shall be eligible for appointment to the Post by direct recruitment, if he has completed or will complete the age of 30 years of the 1st day of July of the year in which the selection made provided in the case of candidates belonging to any of the aboriginal Tribes, in the Agency areas specified in schedule I or to scheduled castes and scheduled
 

Tribes specified in schedule II to Para 1 of the Andhra Pradesh  State and subordinate services rules of the limit of age shall be thirty five years jnsted of 30 years.

Noted :- (i) Preference shall be given to those who possesses BLSc. in addition to the Prescribed qualifications for recruitment to the Posts in categories (i) and (iii) above.
(ii) In the case of persons whose services were taken over by the Zilla Grandhalaya Samsthas as result of transfer of management to the control of the Zilla Grandhalaya Samstha, completed S.S.L.C. with 5 years experience In a recognized Library is a qualification to hold the Post of Librarian, Grade III.
Probation:-   Every person appointed to the post shall, from the date on
which he joins duty, be on probation for a period of one year on duty
within a continuous period of two years, if recruited by transfer or pro­
motion, and for a total period of two years on duty within a continuous
period of three years, if recruited direct.
  1. Tests :   (i)   Every person appointed to the Post of District Central Librarian or City Central Librarian or librarian Grade I shall, during the period of probation, pass the Account Test for subordinate officers Part I fail­ing which he shall not be eligible to draw increments in the time scale of pay applicable to him.  Such ineligibility to draw increments shall not have the effect of postponing his future increments after he has so qualified himself.
(ii) Language Tests: (a) Every person appointed as District Central librarian or City Central Librarian or librarian Grade I shall, within a period of three years from the date of appointment, pass the second class language test in Telugu conducted by the Andhra Pradesh Public Service Commission or any other examination declared by the Government as equivalent failing which his increment in the time scale of pay shall be postponed without cumulative effect till he has passed the test,
(b) Those who are already working as District Central Librarians or City Central librarian or as librarians Grade I shall, within a period of three years from the date of issue of these rules pass (1) Account test for subordinate officers part I and (2) the language Test in Telugu failing which he shall not be eligible to draw increments, such ineligibility to draw increments, shall not have the effects of postponing the future increments after passed the said test.
Provided that a person who has completed the age of 40 years on the 1st November 1968 or has passed his Secondary School Examination with Telugu as Second Language shall not be required to pass the above language test,
8. Savings : Notwithstanding anything in these rules, person working in the posts mentioned in rule 1 on the date of Issue of rules shall not be adversely effected solely by reason of their lacking any of the qualifications prescribed in rules 4 and 5.

The following notification will be published in the Andhra Pradesh Gazette.
NOTIFICATION
In exercise of the powers conferred by clause (e) of sub-section (2) of sec­tion 25 of the Andhra Pradesh Public Libraries Act, 1960 (Andhra Pradesh Act VIII of 1960) the Governor of Andhra Pradesh hereby makes the following rules in respect of employment of the staff for the Public Libraries maintained by (*) Zilla Grandhalaya Samsthas in the State.
The rules hereby made shall be deemed to have come into force on the 1st  day of April, 1960.
RULES
1.   CONSTITUTION:-   The service shall consist of the following categories namely:-
Category 1 — Upper Division Clerks. Category 2 — Lower Division Clerks. Category 3 — Typists.
2.    APPOINTMENT:-   Appointment to the posts shall be made as specified
in the Table below :-

  1. APPOINTING   AUTHORITY;-   The  Chairman   (*) Zilla Grandhalaya
    Samstha shall be the appointing authority in respect of the above posts, provided that for the appointment of Upper Division Clerk the approval of the Secretary, State Library Committee shall be obtained.
  2. AGE:-   (a) No person shall be eligible for appointment to the posts by
    direct recruitment if he  has completed or will complete (*) TWENTY EIGHT
    YEARS of age on the 1st day of July of the year in which the appointment is made.

(**from 1-4-1966) Provided that the maximum age limit prescribed in this rule shall be raised by five years in the case of candidates belonging to any of the aboriginal tribes in the Agency areas specified in Schedule I or the Scheduled Castes or Scheduled Tribes specified in Schedule II to Part-l of the Andhra Pradesh Slate and Subordinate Service Rules.
(b) No person shall be eligible for appointment to the posts mentioned in column (1) of the table below by the method specified in column (2) unless he possesses the qualifications specified in the corresponding entries in column (3) thereof,

5. Probation : Every person appointed to the posts shall from the date on which he joins duty be on probation for a total period of two years on duty within a continuous period of three years if recruited direct; for one year on duty with in a continuous period of two years if appointed by promotion.
Provided that Upper Division Clerk promoted from the lower category who has rendered satisfactory service for a total period of not less than three years in the lower category shall not be required to undergo the probation prescribed in this rule.
Those who are already working as Upper Division Clerk shall with in a period of three years from the date of issue of these rules pass the Account Test for Subordinate Officers Part-I failing which they shall not be eligible to draw increments. Such in eligibility to draw Increments shall not have the effect ofpostponing the future Increments after they have passed the said test.
6.   There shall be paid to the holders of the post a monthly pay calculated
in the scale of pay and allowances which are in force from time to time to similar such posts in Ministerial Service under the Government.
7. SAVINGS:- Notwithstanding any thing in these rules a person who was working in any of the posts mentioned in rules above on the date of (***) issue of these rules shall not be adversely affected solely by reason of his not possessing any of the educational and age qualifications prescribed In these rules.

NOTIFICATION

1)    The rules hereby made shall be deemed to have come into force on 1st day
of April 1950.
CONSTITUTION:- This class shall consist of the Attenders under the *Zilla Grandhalaya Samsthas in the State.
2)    APPOINTMENT:-   Appointment to the post shall be made either by direct
recruitment or by promotion from the category of peons iIn the Zilla Grandhalaya
Samstha   (W.E.F. 11-03-1973 **)
NOTE:-   In every cycle of two vacancies, the first vacancy shall be filled up by direct recruitment and the second vacancy shall be filled up by recruitment by promotion.
  1. APPOINTING AUTHORITY:-   The appointing    authority for  these posts shall be the Chairman, Zilla Grandhalaya Samstha.
  2. QUALIFICATIONS:       (a)   No person shall be eligible for appointment to this post by direct recruitment, if he has completed or will complete Twenty Eight years   (w.e.f. 2-4-1969**) of age on the 1st day of July of the year in  which the selection is made. ***"provided that in the case of candidates belonging to any of the Aboriginal Tribes in the Agency areas specified  in Schedule I or of the  Scheduled Castes or the Scheduled Tribes specified in Schedule II to part I of the Andhra Pradesh State and Subordinate Service  Rules, the age  limit shall  be  taken "Thirty years" instead of "Twenty five years".
    (b) No person shall be eligible for appointment to this post by the method specified in column (1) of the table below unless he possesses the qualifications specified in corresponding entries in column (2) thereof.

    the post by direct recruitment, if he has completed or will complete *28 years
    (*from 2-4-1969) of age on the 1st day of July of the year in which the appointment is made.
  3. (From 1-4-66***) Provided that the maximum age limit prescribed in this rule shall be raised by five years in the case of candidates belonging to any of the Aboriginal Tribes in the Agency Areas specified in Schedule-I or the Scheduled Castes or Scheduled Tribes specified in Schedule-II to part I of the Andhra Pradesh State and Subordinate Service Rules (given effect to from 1-4-1966)
    [b] No person shall be eligible for appointment to the post, by direct recruitment or by transfer, unless he is able to read and write the language or one of the Languages of the district in which the appointment is made.
  1. PROBATION:   Every person appointed to the post shall be on probation for a total period of two years on duty within a continuous period of three years; if recruited direct and for a total period of one year on duty within continuous period of two years, if recruited by transfer.
  2. PAY:   There shall be paid to the holder of the post monthly pay calculated in the scales of   pay   and allowances applicable to similar posts under Government.

RULES
1.   CONSTITUTION:- This service shall consist of Book Binders under the (*)Zilla Grandhalaya Samstha.
2    APPOINTMENT:- Appointment to the posts shall be by direct recruitment, or recruitment by transfer from any other class or service.
3. APPOINTING AUTHORITY:- The appointing authority for the post shall be the Chairman of the (*)Zilla Grandhalaya Samstha.
4. QUALIFICATIONS:- a) No person shall be eligible for appointment to the post by direct recruitment if he has completed or will complete (*from 2-4-1969) 28 years of age on the 1st day July of the year in which the selection for the post is made.

PAY:-   There shall be paid to the holder of the post a monthly pay calculated in the scale of pay which  is   in existence  at  that  time      (+) Plus usual allowance.
SAVINGS :-    Notwithstanding anything in  these rules  a  person   who   is

In exercise of the powers conferred by clause (e) of Sub-Section (2) of Section 25 of the Andhra Pradesh Public Libraries Act (VIII of 1960) the Governor of Andhra Pradesh hereby makes the following rules for the posts of Van Drivers and Motor Cleaners working under (*) Zilla Grandhalaya Samsthas.
1. CONSTITUTION :   The Service shall consist of the following posts :-
1,   Van Drivers               2.   Motor Cleaners.
2. APPOINTMENT :   Appointment to the posts shall be made :-
1     by direct recruitment  or
2.   by transfer from any other class or service.
APPOINTING  AUTHORITY :     The appointing authority shall be the Chairman of the (*) Zilla Grandhalaya Samstha concerned. QUALIFICATIONS:   No person shall be eligible for appointment to the posts in column (1) of the table below unless he possesses  the qualifications mentioned in column (2) thereof.

1.  The Director may either on   application by Zilla Grandhalaya Samsthas or suo-moto, create the posts, mentioned in the annexure to these Rules, for the offices of the Zilla Grandhalaya Samsthas and the Public Libraries established or maintained by the Zilla Grandhalaya Samsthas on such terms and consideration of the need for the creation of the post and also the financial position of the Zilla Grandhalaya Samstha.
2.  All the charges for the   establishment so created shall be met from the Library Fund maintained  under sub-section (1) of Section 21 of the Andhra Pradesh Public Libraries Act, 1960.
3.  The Director may either on application by the Zilla Grandhalaya Samstha or suo-moto abolish or transfer to another Library within the Jurisdiction of the Zilla Grandhalaya Samstha, any of the posts borne on the establishment of the Zilla Grandhalaya Samstha.
4. The posts sanctioned under rule 1 may be either permanent or temporary,   as may be directed by the Director. Provided that no post shall ordinarily be retained on a permanent basis unless it has been in existence for a period of not less than three years and the approval of the Director has been obtained.                                              
5. The Director shall maintain a register showing the number of posts created for the Libraries established or established or maintained by the Zilla Grandhalaya Samsthas.

ANDHRA PRADESH PUBLIC LIBRARIES RULES 1961

I. Under Clause (11) of section 2 of the Andhra Pradesh Public Libraries Act, 1960 (Andhra Pradesh Act No. VlIl of 1960), the Governor of Andhra Pradesh hereby declares that with effect on and from 1st April, 1960 the Asifia Library, Hyderabad, be known as the State Central Library, Hyderabad.
II. In exercise of the powers conferred by sub-section (1) and clause (a) of Sub-section (2) of Section 25 read with Section 6 of the Andhra Pradesh Public Libraries Act, 1960 (Andhra Pradesh Act VIII of 1960) the Governor of Andhra Pradesh hereby makes the following Rules :-
RULES:
1. Short title, extent and commencement: (1) These rules shall be called the Andhra Pradesh Public Libraries Rules, 1961.
(2) They extend to the whole of the State of Andhra Pradesh.
(3) They shall come into force from the date of Publication in the Andhra Pradesh Gazette.

2. Definitions: In these rules unless the context otherwise requires:
i) 'Act' means the Andhra Pradesh Public Libraries Act, 1960 (Andhra Pradesh Act VIII of 1960.)
ii) 'Section? means a section of the Act.
iii) Wards and expressions used but not defined in these rules shall have the meanings respectively assigned to them In the Act
3. Constitution of the State Library Committee :
(1) The Director shall address the Government to move the State Legislature for the election of members to be elected by the Legislature to the Committee, in the manner approved by the Speaker of the Legislative Assembly or the Chairman of the Legislative Council, as the case may be.

(2) In respect of the persons to be *nominated* by the Syndicate of the Universities in the State, the Director shall address the Registrar of each University for *nominating* a member.

(3) The Director shall address the Andhra Pradesh Library Association
for the nomination of three persons. The nomination shall be made by the Executive Committee of the Association
(4) In respect of the persons to be nominated by the Government under
clause (k) of sub-section (2) of section 3 of the Act, the Director shall address the Government

(4-A) If any dispute arises regarding the nomination of election of a member or of members to the Committee the matter shall be referred by the Director to the Government, whose decision thereon shall be final.

(5) [a] When a vacancy in the Committee occurs otherwise than by efflux of time, the Director shall address the appropriate authority with a view to having the vacancy filled up
[b] When a vacancy in the Committee Is due to occur by efflux of time, the Director shall address the appropriate authority one month in advance with a view to having the vacancy filled up as soon as it occurs
4. Meetings of the Committee: (1) The Committee shall meet "at least once in six months and at* such times and in such places as may be determined-ed by the Minister in-charge of Education.

5, Constitution of Zilla Grandhalaya Samstha for Hyderabad City.
(1) Director shall address the Government for nominating four members under Section 10 [1] [a] to the Hyderabad city Grandhalaya Samstha.
[2] [a] When an election is due to beheld under section 10[1][b] the "?Secretary, Hyderabad City Grandhalaya Samstha* shall convene a meeting of the presidents of the Governing bodies of the Public Libraries concerned after giving not less than 15 days notice of the meeting specifying the time and the place at which the meeting will be held for electing members to the Hyderabad City Grandhalaya Samstha.

[b] Copies of the notice referred to in clause [a] shall be served on *presidents* of the governing bodies either in person or by registered post at the addresses furnished in the register referred to in rule 9 [4]. [*substituted by G O. Ms. ND, 452 Edn. dt. 9-3-1970].
[c] The meeting shall be held at the office of the Hyderabad City Grandhalaya Samstha. [d] The election of the members shall be conducted In the manner in dictated m rule 7
[3] [a] The Secretary of the Hyderabad City Grandhalaya Samstha shall address the Commissioner of 'Municipal Corporation of Hyderabad* for the election of two members by the Councillors of the Municipal Corporation.

[b] The election shall be held at a meeting of the *'Municipal Corporation presided over by the Mayor and the procedure to be Followed shall be as indicated in rule 7.

[4] The Secretary of the Hyderabad City Grandhalaya Samstha shall address the Secretary of the Andhra Pradesh Library Association for nominating two members from among the members of the branches of the said Association in Hyderabad City to the Hyderabad City Grandhalaya Samstha. The nominations shall be made by the *Executive Committee * of the Association, [*substituted by G.O.Ms. No. 2374 Edn. dt. 1-8-1962].
[5] [a] When a vacancy or vacancies occur under clause [b] of subsection [1] of section 10, owing to efflux of time or for other reasons, the Secretary of the Hyderabad City Grandhalaya Samstha, shall take immediate action for filling up the vacancy or vacancies In the manner provided in sub-rule [2]. He shall also submit reports to the Director from time to time regarding occurrence of the vacancy or vacancies and the action taken for filling them up,
[b] when vacancies are due to occur under clause [a], [c] or [d] of subsection (1) of section 10, owing to efflux of time, the Secretary of the Hyderabad City Grandhalaya Samstha shall report the matter one month in advance to the Director, the Commissioner of Municipal Corporation of Hyderabad, the Secretary of the Andhra Pradesh Library Association, as the case may be with a view to having them filled up as soon as they occur. When vacancies occur for other reasons, he shall report them at once to the appropriate authority specified above for having them filled up. He shall also submit reports to the Director, front time to time, regarding occurrence of the vacancy or vacancies under clause [c] or [d] of sub-section [1 ] of section 10 of the Act, and the action taken to fill them up"

6. Constitution of Zilla Grandhalaya Samsthas for Districts:
[1] The Director shall address the Government for nominating five members under section 10 (2) (a) to the Zilla Grandhalaya Samstha of the district concerned. ( [*] substituted by G. O. Ms. No. 452 Edn. dated. 9-3-1970.)
[2] (a) When an election is due to be held under section 10 (2) (b) the *Secretary of the Zilla Grandhalaya Samstha shall convene a meeting of the presidents* of the governing bodies of the public libraries at the headquarters of the Revenue Division in which they are situated. He shall give not less than fifteen days notice of the meeting specifying the time and place at which the meeting will be held for electing members to the Zilla Grandhalaya Samstha of the District.

(b) Copies of the notice referred to in clause (a) shall be served on the *presidents* of the governing bodies either in person or by registered poet at the addresses furnished in the register referred to in rule 9

[3} (a) When an election is due to be held under section 10 (2) [c] of the Act, the District Panchayat Officer concerned or ?'*an Extension Officer, Panchayats authorised by him shall convene a meeting of the *Sarpanches of Gram Panchayats* of each taluk concerned, after giving not less than fifteen days' notice of the meeting specifying the time and place at which it will be held for electing a member from the taluk concerned to the Zilla Grandhalaya Samstha of the District

(b) Copies of the notice referred to in clause (a) shall be served on the Sarpanches of Gram Panchayats either in person or by registered post to their official addresses.

[4] An election under section 10 (2) [b] or section 10 [2] [c] shall be held at a meeting presided over by the Secretary, Zilla Grandhalaya Samstha, District Panchayat Officer or *Extension* Officer, [Panchayats] who has convened the meeting. The election shall be conducted in the manner indicated in rules.

[5] When elections are due to be held under clause [d] of sub-section [2] of section 10 of the Act, the following procedure shall be observed:
* [i] The Secretary of the Zilla Grandhalaya Samstha shall address the Secretaries of the Municipal Councils in the District, for the election of one member from among themselves by the Councillors of the Council of every Municipality in the Dist."
* (ii) Immediately after receipt of the notice from the Secretary of the Zilla Grandhalaya Samstha the Secretary of the Municipality shall place it before the Chairman of the Municipal Council who shall take steps to convene and preside over the meeting of the council in which one member shall be elected from among themselves to the Zilla Grandhalaya Samstha. The name and address of the member so elected shall be reported to the Secretary of the Zilla Grandhalaya Samstha.
Explanation:
For the purpose of the above rule Aldermen and the ex-officio Councillors shall be treated as councillors, eligible to participate in the election of a member under section 10 (2) (d) of the Act".

(6) The Secretary of the Zilla Grandhalaya Samstha of each district shall address the President of the District Branch of the Andhra Pradesh Library Association for nominating under section 16 (2) (e) two members to the Zilla Grandhalaya Samstha concerned. The nominations shall be made by the *Executive Committee of the District Branch*.

[7] (a) When a vacancy or vacancies occur under clause (b) of sub-section (2) of section 10 of the Act, owing to efflux of time or for otherreasons, the Secretary of the Zilla Grandhalaya Samstha shall take immediate action for filling up the vacancy or vacancies in the manner provided in sub-rule (2) a . He shall also submit reports to the Director, from time to time, regarding occurrence of the vacancy or vacancies and the action taken for filling them up.
*(b) When vacancies are due to occur under clauses [a], [c], [d] or [e] of sub-section (2) of section 10, owing to efflux of time, the Secretary of the Zilla Grandhalaya Samstha concerned shall report the matter one month in advance to the Director, the District Panchayat Officer, the Secretary to the Municipality concerned or the President of the District Branch of the Andhra Pradesh Library Association, as the case may be with a view to having them filled up as soon as they occur. When vacancies occur for other reasons, he shall report them at once to the appropriate authority specified above for having them filled up. He shall also submit reports to the Director from time to time, regarding occurrence of the vacancy or vacancies under clauses (c), (d) or (e) of subsection (2) of section 10 of the Act, and the action taken to fill them up (*substituted by G O. 7. Election of members: 
(1) The quorum for a meeting convened for the election of a member or members of a Zilla Grandhalaya Samstha shall be * fifty or one-fifth of the total number of members which ever is less who are eligible to attend the meeting, excluding the President of the Meeting. (* substituted by G, 0. Ms. No. 2374 Edn, dated. 1-8-1962)
(2) Every candidate for election shall be proposed by one elector, and seconded by another.
(3) The names of all the candidates who have teen proposed and seconded at the election and who have not withdrawn their candidature shall be read out by the President of the meeting.
(4) If the number of candidates whose names are so read out is equal to the number of vacancies, the President shall declare all such candidates duly elected,
(5) If the number of such candidates is less than the number of vacancies the President shall declare all such candidates duly elected and shall either call for fresh nominations or adjourn the election to fill up the remaining vacancy or vacancies at a subsequent meeting.
(6) If the number of such candidates exceeds the number of vacancies, the votes of electors present at the meeting shall be taken by ballot.
(7) The President shall make adequate arrangements to secure the secrecy of the ballot. He shall not be entitled to vote at the meeting.
(8) Every member wishing to vote shall be supplied with a voting paper which shall be stamped with the official stamp of the President of the meeting on which the name of all such candidates shall be typed or legibly written in the following form in English and In any other language considered necessary by the President of the meeting.

(9) Each elector shall be* entitled to cast as many votes as there are* $vacancies$ giving not more than one vote to any candidate. He shall then proceed to the place set apart for the purpose and there place a mark on the voting paper against the name of the candidate or the names of the candidates for whom he wishes to vote. (10) The ballot box shall be so constructed that the voting paper may be placed therein but not extracted there from without the box being opened.
(11) Immediately after the voting is over the President shall open the ballot box and count the votes in the presence of the electors.
(12) The candidate who obtains the largest number of votes, or if there is more than one vacancy, as many of the candidates at the top of the poll as there are vacancies to be filled, shall be declared to have been duly elected. If there be an equality of votes between any two or more candidates and the addition of one vote to any one or more of such candidates will entitled him or them to be declared duly elected, the President shall decide by drawing lots in the presence of the members to which one or more of such candidates such additional vote shall be deemed to have been given.

(14) A voting paper shall be invalid:
[a] If it bears the signature of the voter, or contains any word, sign or visible representation by which he can be identified, or
[b] if marks are placed thereon against more names of the candidates than there are vacancies to be filled, or
[c] if it is uncertain to which candidate the mark is intended to apply, or
[d] if no mark is placed thereon.
(15) [a] Immediately after the *counting of votes*, the President shall announce the names of persons elected as members of the Zilla Grandhalaya Samstha.

[b] The President shall also draw up a record of the Proceedings and sign it, attesting with his initials every correction made there in and also permit any elector present at the meeting to affix his signature if he desires to do so.
(16) (i) The President of the meeting shall then make up two separate packets, one containing the voting papers which have been counted and the other containing those which have been rejected, seal such packet and note thereon a description & its contents, the number of the voting papers it contains, the election to which it relates and the date thereof. (ii) (a) The packets referred to above shall be kept by the Secretary of the Zilla Grandhalaya Samstha in his own custody for a period of one calendar year and shall, thereafter, unless otherwise directed by the Director, be destroyed.
(b) While in the custody of the Secretary they shall not be opened and their contents shall not be inspected by, or produced before any person of authority, except under the others of the Director,
(17) The Secretary of the Zilla Grandhalaya Samstha shall immediately after the election of the members report to the Director the names of the persons elected as members.

8. Election of Chairman:- (1) [i] The election of the Chairman of a Zilla Grandhalaya Samstha by the members thereof shall be held in the office of the Zilla Grandhalaya Samstha at a meeting specialty convened for the purpose.
[ii] Such meeting shall be convened by the District Educational Officer having jurisdiction over the place where the office of the Zilla Grandhalaya Samstha is situated as soon as possible after its constitution or the occurrence of a vacancy.
 
NOTE :- In the case of election of the Chairman the District Educational Officer who is the election authority should be furnished with rules and all other information and help necessary to conduct the election. The behaviour of the Secretary should be such that there should not be any room or ground for suspicion or complaint of siding one side or the others. Efforts should be made to fill up the vacancies as far as possible before the election of Chairman. But on this account the election of the Chairman need not be postponed and it can be conducted if there is quorum. A notice of ten clear days specifying the date, hour and place of the meeting should be given to the members. The members, who are elected or nominated after the issue of notice are also eligible to participate in the election and it need not be postponed.
The members nominated under section 10 (2) (a) of the Act arc eligible to draw traveling allowance at the prescribed rates from the funds of Zilla Grandhalaya Samstha, to attend the meeting of the election of the Chairman. The other members are also eligible to draw traveling allowance from the body from which they are elected/nominated as the case may be for attending the meeting of the election of the Chairmen.
[iii] Notice of the day and hour of the meeting for the election of the Chairman shall be given to the members of the Zilla Grandhalaya Samstha at least ten clear days before the day of the meeting.
[iv] Such meeting shall be presided over by the District Educational Officer referred to in clause
(ii). (2) The quorum for the meeting shall be six members, but if the number of members of the Zilla Grandhalaya Samstha exceeds sixteen, one-third of that number shall be the quorum.
(3) A candidate for election to the Office of the Chairman shall be proposed by one of the members of the Zilla Grandhalaya Samstha and seconded by a other member. The names of all the candidates who have been proposed and seconded at the election and who have not withdrawn their candidature shall be read out at the meeting by the President of the meeting.
(4) [i] If there is only one duly nominated candidate there shall be no ballot and he shall be declared to have been elected.
[ii] I there are two or more such candidates, the votes of the member of the Zilla Grandhalaya Samstha present at the meeting shall be taken by ballot.
[iii] The President of the meeting shall make adequate arrangements to secure the secrecy of the ballot. He shall not be entitled to vote at the meeting.
(5) Every member entitled and wishing to vote shall be supplied with a voting paper which shall be stamped with the official stamp of the President of the meeting and on which the names of all the candidates shall be printed, typed, cyclostyled, or legibly written in the following form in English and in any other language considered necessary by the President of the meeting,

(6) Immediately after the voting is over the President of the meeting shall open the ballot box and count the votes in the presence of the members and declare the result of the election in accordance with the following instructions:
[i] The candidate who secures the largest number of votes shell be declared to have been duly elected.
[ii] In the event of there being an equality of votes between two or mote candidates at the top of the poll, the President of the Meeting shall cast lots in the presence of the members and the candidate whose name is first drawn shall be declared to have been duly elected,

(8) A voting paper shall be invalid:-

[bl The President shall also record the proceedings in the Minutes Book and sign it, attesting with his initials every correction made therein and also permit any member of the Zilla Grandhalaya Samstha present at the meeting to affix his signature in the Minutes Book, if the member desires to do so.
(10) [i] The President of the meeting shall then make up into separate packets the voting papers relating to each candidate which have been counted. The voting papers relating to each candidate which have been rejected shall also be made up into separate packets. The President of the Meeting shall seal each such packet and note thereon a description of its contents the number of ballot papers it contains the election to which it relates and the date thereon. [ii] (a) The packets referred to above shall be kept by the Secretary of the Zilla Grandhalaya Samstha in his own custody for a period of one calendar year and shall thereafter unless otherwise directed by the Director, be destroyed.
(b) While in custody of the Secretary of the Zilla Grandhalaya Samstha the packets shall not be opened and the contents shall not be inspected by 01 produced before any person or authority, except under the orders of the Director.
(11) The Secretary of the Zilla Grandhalaya Samstha, shall immediately after the election of the Chairman, report to the Director the name of the member elected as Chairman.
8-A Election Petitions: - (j) No election of a member or Chairman of Zilla Grandhalaya Samstha held under the provisions of the Act shall be called m question except by an election petition presented in accordance with this rule to the Director by any candidate or elector against the candidate who has been declared to have been duly elected (hereinafter called the returned candidate) or if there are two or more returned candidates, against all or any such candidates.
(2) The election petition shell be presented within 15 days of the date of the date of the declaration of the result of the election.
(3) The petition shall contain a statement in concise form, of the material facts on which the petitioner relies,
(4) Every returned candidate to whose election the petition refers shall be cited as a respondent in the petition.
(5) When an election petition has been presented, the Director or any Officer of the Department of Public Libraries authorised by the Director (here-inafter called the enquiry officer) shall proceed to enquire into the petition r provided that the Director shall not authorise any Officer lower in rank than a Deputy Director to enquire into an election petition.
(6) The enquiry Officer shall serve a copy of the petition along with a notice stating the date, place and time of the enquiry on each respondent, the Secretary of the Zilla Grandhalaya Samstha concerned and election authority.
He shall also serve a notice on the petitioner informing him of the dale, place and time of the enquiry,
EXPLANATION
For the purposes of this rule, ''Election Authority" means the person presiding over the meeting at which the returned candidate was declared elected.
(7) No election petition shall be withdrawn without the permission of the Director.
(8) If there are more petitioners than one, no application to withdraw a petition shall be made except with the consent of all the petitioners.
(9) An election petition shall abate on the. death of a sole petitioner or of the survivor of several petitioners and such abatement shall be communicated to the Secretary of the Zilla Grandhalaya Samstha concerned and the election authority by the Director.
(10) On the day of enquiry, and on any other day to which the enquiry may be adjourned, the enquiry Officer shall examine the petitioners, the res- pondents and the witnesses, if any, and shall also consider such evidence as may appear to him relevant to the case.
(11) at the conclusion of the enquiry, the enquiry Officer shall declare whether the election of the returned candidate or candidates is valid or void.
(12) If he declares the ejection of the returned candidate or candidates void, he shall further pass an order either:
(a) declaring that any other party to the petition who has under these rules claimed the seat has teen duly elected; or.
(b) directing that a fresh election be held.
(13) The order of the enquiry officer under the sub-rules [11] and [12] shall be final.
(14) A copy of every order under sub-rules [11] and [12] shall be commu- nicated to the Secretary, Zilla Grandhalaya Samstha and the election authority concerned.
V (15) When an election is declared void and a fresh election is ordered, the seat of the returned candidate or the seals of the returned candidates, as thecase may be shall be deemed to be vacant from the date of the order under sub-rule [11] and the election authority shall forthwith take necessary steps -for holding a fresh election,[Rule 8-A inserted by G. O. Ms. No. 2374 Edn. dt. 1-8-1962).
NOTE : Rule 8-A [1] lays down that, no election of a member or Chairman shall be called in question except by an election petition. Hence even if any material irregularities come to the notice of Secretary or Chairman or other members they should refrain from doing anything which amounts to nullifying the election.
8-B. Fresh election of Chairman: If at any lime, the Director of Public Libraries considers that the election of a Chairman of Zilla Grandhalaya Samstha was found to be illegal, he may notwithstanding the provisions in rule 8-A declare such election as void and the election authority shall forthwith take necessary steps for holding a fresh election of the Chairman.

8-C. Resignation of Chairman and Members of Zilla Samstha: The Chairman or any member of the Zilla Grandhalaya Samstha may resign his office as Chairman or member by giving notice in writing to the Zilla Grandhalaya Samstha except in case, where person resigning delivers the notice or such resignation personally to the Secretary, Zilla Grandhalaya Samstha, the Secretary shall on receipt of such notice of resignation obtain confirmation from the person con-cerned as to its genuineness. A resignation delivered personally or confirmed as aforesaid shall take and from the date on which the notice was received.

9. Public Libraries: (1) The Director shall maintain a register of all Public Libraries in the State and Zilla Grandhalaya Samstha shall maintain registers of all Public Libraries within their jurisdictions.
(2) The management of every Public Library, other than those referred to in sub-clause [a], [b] and [c] of clause (9) of section 2 of the Act, shall within thirty days of the establishment of the Library, or if the Library is already in existence, within thirty days of the coming into force of these rules, send to the Secretary of the Zilla Grandhalaya Samstha, in whose jurisdiction the Library is situated, a statement in the following form.
1. Name of the Library.
2. Year of its registration under the Societies Registration Act, 1860 (A copy of the Registration certificate should be enclosed).
3. Name and address of the President of the Governing body:-
a. Date of his election.
b. Date by which his term of office will expire. (A copy of the bye-laws of the Library governing the constitution of the governing body and election of its President should be enclosed.)
4. Reference number and date of order in which the Library was declared eligible for aid.
5. Aid received by the Library:-
a. Year.
b. Amount.
c. Reference number and date of sanction order.
3. Whenever there is a change in the name and address of the President of the governing body, the management of the Library shall report the same to the Secretary of the Zilla Grandhalaya Samstha, within a period of ten days". (sub rule 2 & 3 were substituted in G. O. Ms. No. 452 Edn. dt. 9-3-1970)
4 The Secretary of the Zilla Grandhalaya Samstha shall record these particulars in a register and maintain it up to-date.
9-A. Maintenance of State Registers of Libraries and Librarians :
[1] The Secretary of Zilla Grandhalaya Samstha shall maintain a register of all Public Libraries and Librarians in the District in forms I and II appended to these rules. The Management of the Public Libraries shall report in the said forms the particulars to the Secretary, Zilla Grandhalaya Samstha with in thirty days from the coming into force of these rules
[2] By the end of April, every year, the Secretary of Zilla Grandhalaya Samstha shall report to the Director the list of all Public Libraries and Librarians in the District in the said forms.
[3] Whenever any change occurs In Libraries and Librarians during the occurse of the year, the Secretary, Zilla Grandhalaya Samstha, shall report the same to the Director.

10. Aided Libraries:- [1] Libraries shall be declared eligible for aid by the Director after consulting the Zilla Grandhalaya Samstha concerned,
[2] The following shall be the conditions determining eligibility for aid,
* (i) The Library shall be kept open to the public for consultation of reading materials and for other activities connected with Public Library service including social education without restrictions except those relating to proper behaviour public health and conformity to the bye-laws of the Zilla Grandhalaya Samstha.

(ii) The Director shall fix the minimum working hours of the Library. It shall be located in a place accessible to all communities. ( substituted by G.O. Ms. 2374 Edn. dt. 01-08-1962)
(iii) The Library shall have books and not merely newspapers and periodicals
(iv) The books to be purchased shall conform to the requirements mentioned below:-
[a] They shall be of general interest and of cultural value.
[b] Books abusing communities or religions shall not be purchased.
[c] Books or Magazines which are in doubtful taste or which contain undesirable pictures shall not be purchased.
[d] The industries, agriculture and trades of the locality shall be taken into consideration at the time of purchasing books **provided that the State Library Committee shall be entitled to prohibit or prescribe the purchase of any Magazine, Newspaper, periodical or book within its opinion does not stand the above mentioned tests.

[v] The registers prescribed by the Director shall be maintained in the Library.
[vi] *The Library shall be registered under the Societies Registration Act, 1860 or the Andhra Pradesh (Telangana Area) Public Societies Registration Act, 1350 F. (Act I of 1350 F ) provided that this clause shall not apply to a library maintained by the Government or a Local Body or a Co-operative society.

[vii] The Director or any Officer nominated by him shall be allowed to inspect the Library on any day during working hours in order to satisfy himself that the standards and conditions of eligibility are being maintained.
[viii] Periodicals and ad-hoc returns and reports shall be submitted at such times and incorporating such information as may be required by the Director.
[ix] Each year the annual accounts of the Library duly audited shall be submitted to the Zilla Grandhalaya Samstha concerned.
(3) If the Director has reason to believe that any of the conditions prescribed in Sub-Rule(2) are not fulfilled in respect of a library which has been declared eligible for aid under Sub-Rule [1] he may call on the Secretary of the Library concerned to show cause against withdrawl of aid and removal of the-name of the Library from the list of aided libraries and after considering the replies received if any and after consulting the Zilla Grandhalaya Samstha concerned, pass such orders as he may deem fit.
10-A. Grants shell be sanctioned to the recognised aided Libraries either in the form of cash or books of equivalent value by the Director from the consolidated Fund of the State at the rates prescribed by the Director from time to time subject to the conditions laid down in sub-rules (1) to (3) of rule 10 and also the conditions mentioned below :
(either value. This sentence was inserted by G O Ms. No. 452 Edn. dated, 9-03-1970.
[i] Grants sanctioned by the Director shall be utilised only for the purchase of new books and periodicals.
[li] Before a Library applies for aid, it should have been inspected and satisfactory reported upon at least once by the Secretary of the Zilla Grandhalaya Samstha or any Branch Librarian deputed by him.
[Mil The management of the aided library shall provide the buildings; furniture and the staff required for the library and shall, in addition, contribute from its own funds a sum of not less than the amount of Government grant.
[iv] The indent of books to be purchased shall be approved by the Zilla Grandhalaya Samstha concerned.
[v] The aided libraries shall submit their applications to the Secretary of the Zilla Grandhalaya Samstha concerned before the 1st May of the year to which the sanction of grant relates. The Secretary of the Zilla Grandhalaya Samstha shall submit the same, after due scrutiny to the Director with the specific recommendations of the Zilla Grandhalaya Samstha together with the Inspection Report before the 1st September of the year to which the sanction of grant relates".

11. A Zilla Grandhalaya Samstha may sanction aid to an aided Library from out of the library fund. The aid to be given by the Zilla Grandhalaya Samstha may be.
(1) Non-recurring to meet capital expenditure on buildings, furniture and fittings: or,
(2) Recurring to meet current expenditure on all or any or the following namely:-
(a) The purchase of reading materials and kindred materials relating to other activities connected with public library service including
social education :- (substituted by G. O. Ms. No. 2374 Edn. dated. 1-8-1962)
(b) binding and preservation of reading and kindred materials ;
(c) the payment to the staff ;
(d) deputation allowance for staff deputed for professional training at
institutions approved by the Zilla Grandhalaya Samstha for the purpose.
(e) other Office expenses.
(3) The aid may be both recurring and non-recurring.
12. (1) Non-recurring grant shall be made on such capital expenditure as is made on buildings whose plans and specifications are approved by the Zilla Grandhalaya Samstha and or erected in accordance with the estimates approved by it.
(2) The non-recurring grant shall bear such proportion to the actual expenditure as is fixed by the Director from time to time, subject to a maximum amount determined by the Director in relation to the approved estimate.
13. (1) The recurring grant for a financial year shall be sanctioned by the Zilla Grandhalaya Samstha on the basis of the expenditure for the proceeding financial year as shown in the accounts and balance sheet in the report of the approved auditor;
Provided that the estimated expenditure of the current year approved by the Zilla Grandhalaya Samstha may form the basis for the first year in which a library is given aid. Any adjustment in the amount of recurring grant of the first year may be made in the next year.
(2) The recurring grant shall bear such proportion to the actual expenditure as is fixed by the Director from time to time.
NOTE: As per A.P.P.L Rules 1961, Rule 10-A (v) laid down that the aided libraries shall submit their applications for grant before 1st May every year and the Secretary, Zilla Grandhalaya Samstha after due Scrutiny submit them to the Director of Public Libraries, along with the inspection reports and
the specific recommendations of the Zilla Grandhalaya Samstha before the first September. Detailed instructions have been given by the Director regarding the scrutiny of books, vouchers, preparation of applications, inspection report, and other certificates to be furnished by the Inspecting Officer and the Secretaries (Vide D's proc Rc. No. 3-C4/72 dt. 7-4-72). The Inspecting Officer shall be responsible for accuracy of particulars. He shall satisfy himself that the library is functioning properly and then only recommend grant. He shall personally go to the spot and inspect the Library, but not request the management to produce the records to his library.
The bills and vouchers the new books purchased in the year may he furnished with accession numbers. Other wise certificated copy may be obtained and accession numbers note therein. All the columns in the inspection report shall be filled in and inaccurate and exaggerated figures may be avoided. The resolutions of the Zilla Grandhalaya Samstha for the grant to each library may be obtained and submitted to the Director.
On receipt of the sanctioning orders, the Secretary shall prepare bills and submit the same for counter signature of the Director or an Officer authorised. The sanction may be communicated to the aided libraries and request them to furnish the list of books proposed to be purchased by them. On receipt of the lists the same may be approved and the grants may be disbursed to them either by Cheques or Bank drafts as the case may be by the Secretary. The vouchers books etc can be scrutinized at the next inspection. A grant in Aid register in the prescribed form shall be maintained in the office of the Zilla Grandhalaya Samstha. The audited statement of accounts need not be scrutinised by Chartered Auditor and the Accounts prepared by the management will be scrutinised by the inspecting Officer.
(14) Duties of the Chairman and Secretary;
(1) The duties of the Zilla Grandhalaya Samstha shall be as follows:
[a] He shall preside over all the meetings of the Zilla Grandhalaya Samstha provided that if the Chairman is unable to attend a meeting of the members present shall elect one of themselves to preside over the meeting during the Chairman's absence.
[b] He shall exercise general control over the Zilla Grandhalaya Samstha.
[c] He shall appoint the staff of the Zilla Grandhalaya Samstha provided that for the appointment of District Central librarians, Upper Division Clerks, technical staff such as Children's librarians, Branch librarians and Assistant librarians, the approval of the Secretary, State library Committee shall be obtained.

(2) The duties of the Secretary of the Zilla Grandhalaya Samstha shall be as follows:-
[a] He shall convene the meetings of the Zilla Grandhalaya Samstha and shall be subordinate to the Chairman.
[b] He shall be responsible for the proper control and supervision of the office of the Zilla Grandhalaya Samstha and librarians appointed by the Zilla Grandhalaya Samstha.
[c] He shall submit the recommendations to the Chairman for filling up a vacancy or vacancies in the office of the Zilla Grandhalaya Samstha and in Libraries under the control of the Zilla Grandhalaya Samstha
[d] He shall post the Chairman with all rules, etc and up to-date information regarding the working of the Libraries in the District.
[e] He shall submit to the Director through the Chairman not later than the 30th April every year, a report on the working of the Public libraries in the District during the preceding year.
[f] He shall be responsible in all administrative matters and for the prompt submission of all replies and returns as when called for by the Director.
[g] He shall be responsible for implementing the resolutions passed by the Zilla Grandhalaya Samstha for its sub-committees [and he shall bring to the notice of the Director, for his orders, any resolutions which are not in accordance with the Act and these rules]

[h] He shall draw up the schemes to be submitted by Zilla Grandhalaya Samstha to the Director.
[i] He shall correspond with the Director; but in all policy matters, the prior approval of the Chairman shall be obtained.
[ j] He shall be responsible for proper administration of the Library Fund
(3) The Cheque Book shall be under the custody of the Secretary in the office of the Zilla Grandhalaya Samstha.
15. Schemes to be submitted by Zilla Grandhalaya Samstha:-
(1) In this rule and rule 16 "Local Body? shall mean:-
[i] A Municipality (i.e. a Municipal Town or Corporation).
[ii] A Panchayat Samithi.
[iii] A Zilla Parishad in respect of those areas within its jurisdiction for which Panchayat Samithis are not functioning. (2) Each Zilla Grandhalaya Samstha shall first prepare and submit to the Director a tentative outline scheme giving in skeleton form, a picture of the number of main and branch libraries and delivery stations which its area should have ultimately, i.e. when the spread of library service reaches its fullness.
(3) When preparing the tentative scheme, the Zilla Grandhalaya Samstha shall consult the local bodies within its jurisdiction regarding the needs of their respective areas and their willingness to fulfill these needs.
14. A tentative outline scheme shall give the following and any other relevant Information:-
(1) A map of each municipality lying within the positions of the main library and branch libraries, if any, (existing and proposed), shown by distinctive marks.
(2) The basis for the map of each municipality shall be as follows:-
[a] If the population does not exceed 50,000 one main library.
[b] If the population exceeds 50,000 one main library and in addition, a branch library for every 25,000 people in excess of 50,000.
(3) A map of *each district with the position of each municipality and of the main and branch libraries and delivery stations (existing and proposed) to serve the whole of the District shown by distinctive marks.

(4) The basis of the map of a rural area, i.e. the jurisdiction of the Zilla Grandhalaya Samstha excluding the Municipalities laying within it, shall be as follows:
[a] One District Central Library, i.e. the main library of the District head quarters town in all 'districts except Hyderabad where the District Central Library shall be located at Vikarabad.
[b] One branch library for each Panchayat with a population of 5,000 and above and in exceptional cases, with the permission of the Government, a branch library may be provided for a Panchayat with a population of less than 5,000.
EXPLANATION
In this rule, the expression, population means the population as ascertained at the last proceeding census of which the relevant figures have been published.
(Clause [b] substituted and explanation added by G, O. Ms. No. 1925 Edn. dated 14-9-1967).
(c) One delivery station for each village or group of villages with a population between 1,000 and 5,000 and if possible, one delivery station for each village or group of villages, with a population below 1,000.
(3) A tabular statement of the materiel given in the map under the following heads:-
(a) for each municipality
[i] Area,
[ii] Population.
[iii] Number of main and Branch Libraries (existing and proposed).
(b) for each district:
[i] Aiea.
[ii] Population,
[iii] Number of Municipalities :
(a) To all population of the Municipalities.
(b) Number of main and branch Libraries in Municipalities (existing and proposed).
[iv] Number of Panchayats with a population of more than 5,000 and their total population.
[v] Number of Branch Libraries in each Panchayat (existing and proposed).
[vi] Balance of the population.
[vii] Number of villages or groups of villages with a population between, 5,000 and 1,000 and their total population.

[viii] Number of delivery stations in such villages or groups of villages (existing and proposed).
[ix] Number of villages with a population of less than 1,000 and their total population.
[x] Number of delivery stations in such villages and groups of villages (existing and proposed)
NOTE: The scheme should indicate which of the proposed main and branch libraries and delivery stations will be established by the Zilla Grandhalaya Samstha and which will be aided libraries maintained by the local bodies concerned.

17. Financial Rules: General (1) The Library Fund of a Zilla Grandhalaya Samstha maintained under section 21 of the Act shall be deposited in the nearest Government Treasury.
Provided that the Zilla Grandhalaya Samstha may, with the sanction of the Director for specified reasons and for a specified amount have a current account with a Local Bank ;
Provided further that the Zilla Grandhalaya Samstha may with the sanction of the Director invest any sums not required for immediate use either in a Savings Bank or in Government Securities or in any other securities which may be approved by the Director.
NOTE : The Zilla Grandhalaya Samstha can invest any sums not required for immediate use after obtaining the resolution of the Samstha. The Secretary shall submit an application specifying the details along with the resolution of Samstha to the Director. According to the existing orders the amount shall be invested in the Cooperative Central Bank only. On receipt of the Directors permission the Secretary can invest the same in the Cooperative Central Bank only.
Provided also that the Director may sanction permanent advance to the Office of the Zilla Grandhalaya Samstha and the libraries under its control.
(2) All payments out of Library Fund of every Zilla Grandhalaya Samstha in respect of the bills presented to the Zilla Grandhalaya Samstha shall be madeonly after the bills are passed by the Secretary of the Zilla Grandhalaya Samstha.
(3) Except in the case of petty contingent expenditure from permanent advance payments shall be made by cheques drawn on the treasury or bank in which the Library Fund of Zilla Grandhalaya Samstha is lodged,
(4) The Treasury or Bank in which the Library Fund is deposited shall so far as the Fund to the credit of the Zilla Grandhalaya Samstha admit pay all orders or cheques against the Fund which are so signed and countersigned.
(5) All orders or cheques against the Library Fund shall be signed by the Secretary of the Zilla Grandhalaya Samstha and countersigned by the Chair man.
Provided that in the absence of the Chairman or where there is no Chairman, all orders or cheques against the library Fund shall be signed by the Secretary and countersigned by a member of the Zilla Grandhalaya Samstha authorised by the Director.
The responsibility for any illegal, irregular, un-authorised or over payment shall rest with the Secretary who shall be required to make good the same. In cases, however where the Chairman issues orders authorising expenditure contrary to rules and Against the advice of the Secretary, responsibility for the illegal, irregular, un-authorised or over payment shall rest with the Chairman
who shall be required to make good the same". (Rule 17 was added by G. O. Ms. No 2374 Edn dt. 1-8-1962 and substituted by G. O. Ms. No. 675 Edn dt. 21-3-1967).
18. Cess Collections:
(1) Cess shall be collected promptly by the local Authorities mentioned In sub-section
(2) of section 20 of the Act and 75% of the Cess collections so made in a particular year be remitted by the said local Authorities to the Treasury Account of the Zilla Grandhalaya Samsthas concerned immediately after the close of the financial year and the balance of 25% be remitted after the audited figures become available.
(2) The Secretary of a Zilla Grandhalaya Samstha shall report to the Director the failure of a local Authority to collect Cess and the Director shall bring it to the notice of the Director of Municipal Administration in the case of a Municipal Committee or Municipal Corporation o? the Collector, in the case of any other Local Authority.
(3) The Director of Municipal Administration and the Collector shall take disciplinary action against the person or persons responsible for the delay in the remittance of the Cess to the Zilla Grandhalaya Samstha.
(Rule 18 was added by G.O. Ms. No. 2374 Edn dated 1-8-62 sub-rule 1 to 3 were substituted for 1 and 2 by G. O. Ms No. 918 Edn. dt. 8-4-1966).
NOTE : The Director is being issuing instructions from time to time on the steps to be taken regarding the realisation of Cess. The Secretaries are requested to contact District Panchayat Officers, Secretaries of Municipalities, District Collector and discuss with them about Cess Collections and also request them to Cooperate with the Samstha and render all possible assistance so as to provide better library facilities in the District. The monthly return prescribed on Cess Collections by the Director may be submitted regularly. They can attend the monthly meetings of the Block Development Officers at the revenue divisions request them to collect cheques from Sarpanches and gave it to them at the next meeting. All efforts should be made in this direction. The D. C. B. register shall be maintained properly and the same may be watched promptly.
The Cheques received from Panchayats may carefully be entered in the register and sent to the concerned Treasury or Sub-Treasury for realisation. If there is any difficulty, the Secretary may contact the concerned persons in this regard and see that such difficulties are overcome. No cheque should be lost or reminded un-cashed by the end of the year. The Cooperation of members of Samstha, the staff and Chairman may be fully utilised for Cess collections When the procedure for the Cess collections is changed in course of time, many of the hardships will be mitigated.
19. Budget: The Zilla Grandhalaya Samstha shall submit to the Director, budget estimates of receipts and expenditure for every year by 1st February of the proceeding year and the Director shall approve them with or without modifications. (This rule was added by G. O. Ms. No. 2374 Edn. dt. 1-8-1962).
20. Audit, Surcharge and Allowance:
(1) [a] The Accounts of each Zilla Grandhalaya Samstha shall be audited annually by the Examiner of Local Fund Accounts and his departmental staff or by the Departmental Auditors authorised by the Director. (substituted for original by G. 0 Ms No 918 Edn. dt. 8-4-1966).
[b] The Zilla Grandhalaya Samsthas shall submit all their accounts to the Auditors as required by them.
(2) The auditors may:-
[i] in writing, require the production of any book, deed, contract, account, voucher, receipt or other documents, the perusal or examination of which they consider necessary.
[ii] in writing require any person who has the custody or control of any such document or who is accountable for it to appeal in person before them.
[iii] require any person so appearing to make and sign a declaration with respect to such document or to answer any question or to prepare and furnish any statement relating thereto.
(3) Auditors shall:-
[i] report to the Zilla Grandhalaya Samstha any material impropriety or irregularity which they may have observe in the expenditure or recovery of moneys due to the Zilla Grandhalaya Samsthas or in the accounts;
[ii] furnish to the Zilla Grandhalaya Samstha such information as it may require concerning the progress of their audit;
[iii] report to the Zilla Grandhalaya Samstha any loss or waste of money or other property owned by or vested in the Zilla Grandhalaya Samstha caused by neglect or misconduct, with the names of persons directly or indirectly responsible for such, loss or waste and;
[iv] submit to the Zilla Grandhalaya Samstha a final statement of the audit and a copy thereof to the Director on or before 30th June of every year or within such period as the Govt. may from time to time notify,
(substituted for original clause by G. O. Ms. No. 30 Edn, dt. 5-1-68).

(4) The Secretary to the Zilla Grandhalaya Samstha shall submit replies to the audit reports to the Director and a copy thereof shall be submitted to the examiner of Local Fund Accounts. The Director shall review the replies with reference to the remarks of the Examiner of Local Fund Accounts, if any, and issue necessary instructions to the Zilla Grandhalaya Samstha.
(This clause was substituted for the amended clause by G. O. Ms. No. 452 Edn. dt. 9-3-1970).
(5) The Director shall submit to Government for their information within one month of the receipt of the reports referred to above a consolidated review of these reports with special reference to the irregularities and special features; if any, noticed in Audit and the action taken to remedy them.
(On receipt of Government orders on the audit report, the audit report shall be published by the Zilla Grandhalaya Samstha.) (the bracketed woids were added by G. O. Ms. No. 963 Edn. dt. 12-4-63).
(6) The auditors may disallow every item contrary to law and surcharge the same on the person making or authorising any person to make such payment and may charge against any person responsible therefore the amount of any deficiency, loss or unprofitable outlay incurred by the negligence or mis-conduct of that person or of any sum which ought to have been, but is not brought into account by that person and shall in every such case, certify the amount due from such person, (substituted for original in G. O. Ms. No. 918 Edn. dt. 8-4-1966).
(7) The auditors shall state in writing the reasons for their decision in respect of every disallowance, surcharge or charge.
(8) Every sum certified to be due from any person by the auditors under the Act, shall be paid by such person to the Zilla Grandhalaya Samstha within 14 days, from the date of intimation by the Chairman of the said Samstha or by the Director of Public Libraries to such person of the decision of the auditors unless within that time he has appealed to the Government against the decisions and such sum if not so paid or such sum as the Government shall on appeal, declare to be due shall be recoverable by the Zilla Grandhalaya Samstha.
(9) Notwithstanding anything contained in these rules, the Government may at any time direct that the recovery of the whole or any part of the amount certified to be due from any person by auditors under the Act shall be waived, if in their opinion such a course is necessary considering all the circumstances of the case.

NOTE ; At the request of the Department the L.F, Auditors are taking up the Audit work from the middle of April. According to the APPL Rules it shall take place in May. Before the audit takes place all the registers and records shall be brought up to-date. It is desirable to make a review of all the accounts, registers etc. so as to rectify the defects noticed before they are pointed out by audit.
After the receipt of the audit report recoveries ordered in the audit report should be effected promptly. The persons concerned should be served with notices as per rule 20 (8) of the APPL Rules 1961 for refunding the amounts to certified by the auditors. Recovery of small sums towards excess T. A. etc. should be made from the pay bill of the concerned employee.
Wherever orders of Director of Public Libraries or Government have to be obtained, proposals should be submitted immediately. The replies to the audit report shall be placed before Zilla Grandhalaya Samstha at its meeting.
It was observed that pending audit objections are being repeated in the audit reports. The Secretaries should review the pending audit objections and initiate action for their earliest settlement. The quarterly progress report of audit objections pending may be submitted to the Director promptly.
21. Inspection and Reports :
(1) The District Central Libraries and the offices of Zilla Grandhalaya Samsthas shall be inspected by the Director of Public Libraries or an Officer deputed by him (at least) once a year.
(2) The Branch Libraries shall be inspected by the Secretary of the Zilla Grandhalaya Samstha concerned [at least] once a year, [The words (at least) ware inserted by G. O. Ms. No. 918 Edn. dt. 8-4-66].
(3) The Secretaries of the Zilla Grandhalaya Samsthas shall submit copies of the reports of the Inspections conducted by them to the Director within 15 clays from the date of the Inspection.

OPENING OF A FRESH VILLAGE BRANCH LIBRARYUNDER THE CONTROL OF ZILLA GRANDHALAYA SAMSTHA (Particulars to be furnished in the following form)
1. Name of the District and Zilla Grandhalaya Samstha:
2. Name of the Locality where the library is proposed to be opened.
3. Whether Branch Library/ Children's Library/ Village library.
4. Population of the locality as per latest census repot.
5 Library Cess collections in the locality for the past 3 years.

7. Staff Employed Qualifications Pay and allowances.
8. Total number of years of service put in by them, their date of birth and present age.
9. Whether the management is willing to transfer their services and if so the post for which they are qualified to work under Zilla Grandhalaya Samstha and whether they are willing for the same.
10. Total value of the property to be handed over to the Zilla Grandhalaya Samstha.
11. Probable expenditure to be incurred on the staff, books and furniture during the year.
12. REMARKS:
NOTE: The management who is handing over the library shall pass a resolution clearly and specifically their intention for handing over the library mentioning the movable and immovable properties that are given to the Zilla Grandhalaya Samstha. The Zilla Grandhalaya Samstha shall also pass a similar resolution for taking over the library. The Secretary shall submit along with the covering letter to the Director both the resolutions and the particulars in the form for permission. Due to ban at present the taking over of the libraries discontinued.
